This information note is issued by Azienda Agricola Bastianelli (hereinafter Azienda Agricola Bastianelli or the “Company”), having its registered office in Via Tenna Loc. Archetti – 63025 Piane di Rapagnano – (FM) acting as Data Controller, and describes procedures for collecting and using the user’s personal data in accordance with Italian law and in particular of Legislative Decree n. 196/2003 (Privacy Code) and in accordance with the Recommendation n. 2/2001 that the European Authorities for the protection of personal data, gathered in the Group instituted by art. 29 of Directive No. 95/46/CE, adopted May 17, 2001 to identify some minimum requirements for the collection of personal data online.
All treatment of personal data will be carried out in accordance with the principles of necessity, correctness, legality, proportionality and transparency. Where necessary, in relation to any specific use or treatment of Personal Data, the user’s prior written consent will be requested.
Although not mandatory, failure to provide certain data for the purposes specified below may make it impossible to perform all or part of the services requested.

It is possible to access the site without having to supply any personal data. However, during their normal operation, the computer systems and software used to operate this site acquire some personal data, the transmission of which is implicit in the use of Internet communication protocols.

Art. 2. Provision of data and consequences in case of non-consent to treatment
The provision of data for the purposes set forth in letters a) and b) above of art. 1 is purely optional. However, because such treatment is needed to allow the registration to the site and, therefore, the provision of the services offered by Azienda Agricola Bastianelli through the site, including the e-commerce service, any refusal to provide such data will make it impossible to complete the registration procedure and to make purchases on the site.
If, after registering, the user intends to conclude an on-line purchase of products, they must provide some additional personal data to those already conferred upon registration to the site and, in particular, those relating to the address of delivery of the products to be purchased. For the purposes set forth in letters a) and b) of art. 1 above, the user’s personal data will be processed by employees or collaborators of Azienda Agricola Bastianelli acting as processing representatives or controllers.
Information may also be disclosed:
a) to all the subjects (including Public Authorities) who have access to personal data pursuant to legislative or administrative measures;
b) to companies or third parties in charge of printing services, packaging, shipping and/or delivery of products purchased through the site;
c) to post offices, couriers or carriers in charge of delivering of the products purchased through the site;
d) to companies, consultants or professionals that may be responsible for the installation, maintenance, updating and, in general, the management of the Company hardware and software or that the Company uses to deliver its services;

Art. 6. Preservation of personal data
Users’ personal data will be preserved only for the time necessary to ensure the proper provision of services.
In case of cancellation, exclusion or disabling due to a lack of use of your account on the site, the user data will be stored for administrative purposes for a period of up to a quarter, without prejudice to any specific legal obligations on the preservation of accounting documentation or for public safety purposes. In such cases, automatic deletion of data will be guaranteed even by third parties to whom they might have been communicated.

Pursuant to Art. 7 of the Privacy Code, the user has the right to:
a) obtain confirmation of the existence or not of his/her personal data and their communication in intelligible form;
b) obtain, by the Owner or the person in charge/data controllers:
-indications of the origin of personal data, the purposes and methods of processing, on the logic applied in case of treatment performed with the aid of electronic instruments;
-indication of the identity of the data controller and of the responsible persons, as well as eventually of the representative designated by a foreign entity to process data in Italy;
-indication of the subjects or categories of subjects to whom the data may be communicated or who may become aware of them in their capacity as designated representatives in the territory of the State, managers or agents.
c) obtain: – the updating, rectification or, when interested, integration of data;
– the cancellation, transformation into anonymous form or blocking of data processed unlawfully, including those that do not need to be kept for the purposes for which the data were collected or subsequently processed;
– the certification that the operations as per letters a) and b) above were made known, including their contents, to those to whom the data were communicated or disclosed, except where this is impossible or involves a commitment of resources clearly disproportionate to the protected right.
